What is NRI Court Marriage Process?

Court marriage is all in trend these days as it makes the long process convenient and less time-consuming. Those who want to save the money on their marriage, or are from different religions or when their family does not agree to the marriage, they can go for the court marriage process.

It is governed by the Special Marriage Act, 1954 where the marriage is done by a civil ceremony between parties belonging to different religions. The court marriage can also take place when one of the parties is NRI i.e. non-resident of India.

A marriage between parties one of whom at least is a citizen of India is also solemnized under the Special Marriage Act, in India before a Marriage Registrar in India or a Marriage Officer in a foreign country. The eligibility criteria are the same as any other court marriage, however, documents required are as follows:

  • Application form signed by both the parties.
  • Documentary evidence of the date of birth of the parties.
  • Passport copy of both the parties with valid Visa.
  • Proof of Residence of both the parties.
  • Documentary evidence for stay at district in India of one of the parties for more than 30 days.
  • Marital Status certificate from the concerned embassy or Consulate in India by a foreigner partner.
  • Death certificate or divorce decree in case one of the parties had any marriages in the past.

 

The procedure involved in court marriage with NRI is as follows:

  • ​​​​​​The parties to the marriage have to give notice in writing in the form specified, to the Marriage Officer of the district in which at least one of the parties to the marriage has resided for a period of not less than 30 days immediately preceding the date on which such notice is given. 
  • All the documents need to be verified at the Office of Marriage Registrar.
  • The law of other nation should not be in conflict with Indian laws.
  • The notice is published inviting objection to the marriage if any.
  • If no objection is received, then, on the expiry of the notice publishing period, the marriage will be made official.
  • The marriage shall be made official in the presence of at least three witnesses.
